    As far as eminent domain goes, I’d actually like to see Bush use eminent domain to seize the intellectual property covering the armor being put on humvees.
    .
    The company doing the armor has limited capacity, and the armoring is done as a retrofit, requiring partial disassembly of the completed vehicles, at a plant 4 hours away from the humvee factory.
    .
    That company, in order to maintain its profits, has been resisting attempts by the military to license the IP so that other companies can start building armored humvees on the manufacturing line, reducing delays and expense.

    The public use seems clear enough. How would you determine “just compensation” in that case?
